Terms of Use
1. Scope and contracting party
These terms apply to the use of the app “ARC” (hereinafter “we” or “ARC”). By installing and using the app, a usage agreement is formed between you and us.
Important to distinguish: If you buy a subscription, the purchase contract for it is not formed with us but with Apple. Apple handles the sale, billing, renewal, cancellation and refund. Apple's own terms apply to that. We only learn whether your subscription is active.
2. What ARC is
ARC is an iOS app that accompanies you along a path of 180 days. Every day you get core quests and prove them – depending on the task with a photo or screenshot, a focus session, a timer, a breathing exercise, a short text, or repetitions that the camera counter counts. An AI model checks photos and screenshots for whether the task was recognizably completed. Completed tasks earn “cookies”, which let you buy back screen time for apps you previously locked yourself. The lock itself runs through Apple's Screen Time feature.
On top of that come features for doing things together: weekly leagues, friends, 7-day challenges and a chat. The rules from section 9 apply to them in addition.
3. What ARC is not
ARC is a tool for organizing yourself. It is not a medical, psychological or therapeutic service and does not replace treatment, counseling or diagnosis. If you are not feeling well, please contact a doctor or a counseling service. The tasks in ARC are deliberately kept moderate; they contain no diet, weight-loss or calorie targets. Whether a task or challenge is right for you is always your own decision.
4. Requirements for use
ARC is aimed at people aged 13 and over. If you are younger, you may not use the app. You need an iPhone with iOS 16 or newer, an internet connection and – for the lock feature – the Screen Time permission.
If you are under 18, you need the consent of a parent or another legal guardian to use the app and especially to enter into a subscription. That is not a formality of ours, but German law (§§ 106 et seq. German Civil Code, BGB): contracts that minors conclude without this consent are provisionally invalid (schwebend unwirksam). So talk to your parents briefly before you pay.
If you are under 16, a parent must additionally consent to the processing of your information by the AI model – everything about this is in the Privacy Policy.
5. Subscriptions and prices
You download the app for free from the App Store. You can use ARC with a subscription – or with an invite code (section 8). The following prices currently apply (final prices including statutory VAT, handled through the App Store):
- Weekly: €4.99
- Yearly: €59.99
Subscriptions renew automatically for the term you chose unless they are canceled at least 24 hours before the end of the current period. You cancel in the subscription settings of your Apple account, not with us. Price changes apply only to future billing periods; Apple informs you beforehand and, where required, obtains your consent.
6. Withdrawal and refunds
Since the purchase contract is formed with Apple, withdrawal and refunds are governed by the App Store's terms. You request refunds directly from Apple via reportaproblem.apple.com.
For the usage agreement with us: you can end it at any time and without notice by deleting your account in the app under Settings → Delete account (in older versions: Profile → Delete account) or by deleting the app. A running subscription does not end automatically as a result – you also have to cancel that with Apple.
7. Cookies, XP and leagues as a game
The “cookies” earned in the app are purely a progress currency within ARC. They have no monetary value, are not transferable, cannot be paid out and cannot be exchanged for money. The same applies to XP, league spots, streaks and challenge results. When the account is deleted, they expire without compensation.
8. Free trial period and invite codes
If Apple offers a free trial period when you take out a subscription from section 5 (introductory offer, currently 7 days), the subscription starts immediately; the first charge only happens after the trial period ends. The subscription then renews automatically at the displayed price unless you cancel it in the subscription settings of your Apple account at least 24 hours before the end of the trial period. If you cancel during the trial period, you are not charged. Whether and for how long a trial period is offered, you can see in the purchase dialog before buying; there is no entitlement to one.
Invite codes we issue free of charge to individual people and groups. A code unlocks ARC Pro for the duration stored with the code, without a subscription and without a charge; after it expires, section 5 applies again. Codes are not sold, are not transferable, cannot be exchanged for money, and may be limited (number, deadline) or revoked in case of misuse. There is no entitlement to a code.
9. Leagues, friends, challenges and chat
These features are optional. What others see of you there is described in section 4 of the Privacy Policy.
9.1 Rules for getting along
ARC should be a place where people spur each other on. The following in particular are not allowed:
- insults, threats, bullying, harassment, hate speech and discrimination;
- sexual content of any kind and any contact made with sexual intent – all the more so toward minors;
- glorification of violence, encouragement of self-harm and dangerous dares;
- advertising, spam, chain letters and links to third-party offers;
- addresses, phone numbers, photos or other personal data of others without their consent;
- usernames and profiles that insult or impersonate other people;
- fake measurements, multiple accounts and other tricks to manipulate rankings or challenges;
- anything that violates applicable law.
9.2 Challenges and leagues
Challenges are a game among friends – without stakes, without winnings and without prizes. Measurements are taken with your iPhone's features (camera counter, motion sensor, Screen Time); such measurements can be inaccurate or fail. There is no entitlement to a particular score, league spot or promotion. We may adjust the rules of leagues and challenges to keep them fair. Only move as much as is good for you, and stop if you feel pain.
9.3 How we moderate
An automatic word filter masks a fixed list of insults and hate terms in messages and bios and rejects usernames containing such words. Everything else is reviewed by humans: we look at reported content and decide promptly. Depending on severity, we may remove content, restrict individual features (such as the chat), block an account from the shared features, or, in the case of serious or repeated violations, terminate the usage agreement. If we learn of content that points to a danger to a person's life or safety, we inform the responsible authorities.
If we restrict your content or your account, we tell you what we did and why – as far as that is possible and no legal reason prevents it. If you disagree, write to us; we will then review the decision again.
9.4 Reporting content
In the app, you report a message by long-pressing it and choosing “Report”; there you can also block the person. We also accept notices about unlawful content at any time by email at support@tryarcapp.com. Helpful: which content it is (username, chat, approximate time), why you consider it unlawful, and your contact address if you would like a reply.
9.5 Responsibility for content
Whoever writes messages, bios and usernames is responsible for them. We do not adopt other users' content as our own and do not monitor the chat on our own initiative; we act as soon as we learn of a violation.
9.6 Contact point
Central contact point for users and authorities under Art. 11 and 12 of the Digital Services Act: support@tryarcapp.com – in German or English.
10. Your obligations
Use ARC the way it is meant to be used. In particular: prove tasks only with photos and screenshots that you took yourself and that actually show the task. Do not upload content that infringes third-party rights or violates laws. Do not try to technically circumvent the photo check, the lock feature, the measurements in challenges or the subscription control. Follow the rules from section 9. In the case of significant or repeated violations, we may block access in whole or in part.
11. Availability and further development
We keep developing ARC; features may be added, changed or removed. We do not owe any particular availability – maintenance work, outages at service providers or changes to Apple's interfaces can temporarily limit operation. We announce significant limitations as far as we are able to. Paid features that are permanently removed entitle you to cancel the subscription with Apple.
12. Liability
We are liable without limitation for intent and gross negligence and for damages from injury to life, body or health. In cases of simple negligence, we are liable only for breach of an essential contractual obligation – that is, an obligation whose fulfillment is what makes proper performance of the contract possible in the first place and on whose observance you can regularly rely – and limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
13. Changes to these terms
We may amend these terms with effect for the future if the legal situation, case law or our range of services changes. We inform you of material changes at least six weeks in advance in the app or by email. If you do not object by the time they take effect, the amended terms are deemed accepted; we point this out to you separately in the notice. If you object, you can end the contract at any time.
14. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If your habitual residence is in another EU member state, the mandatory consumer protection provisions of that state also apply – so this choice of law takes nothing away from you.
15. Severability clause
If any provision of these terms is invalid, the rest of the contract remains valid. The statutory provision takes the place of the invalid provision.
